The procedure of preparation of the EAG documents

The procedure of preparation of the EAG documents including those for the EAG Plenary events is regulated by the EAG document WGEL (2011) 12 rev. 7 adopted by the 19th EAG Plenary session in November 2013:

"Rules of Procedure of Carrying Out the Eurasian Group on Combating Money Laundering and Financing of Terrorism (EAG) Plenary and Working Group Meetings"

CHAPTER 3

The procedure of preparation of the EAG documents

a. Types of the EAG documents

35. In the course of the EAG activities the following types of documents are adopted:

  • international, including international legal
  • internal
  • public.
  • 36. The international documents include international legal documents, international agreements, the memorandums, the protocols and other documents, which are signed between the EAG and the EAG member-state; between the EAG and other international organizations. Such documents may be signed by the EAG Chairman or Deputy Chairman on the basis of delegation of authority by the EAG Plenary.

    37. The EAG internal documents are documents which are approved by the EAG Plenary meeting apart from the international documents as mentioned in para 36 above and the public documents. The internal documents can be of the open or confidential types. The internal documents of the open type are published on the EAG website. The internal documents of the confidential type can be placed in the closed part of the EAG website accessed by relevant persons only. The decision to grant the confidential status to the document (or part of the document) can be adopted by the EAG Plenary meeting, the EAG Chairman, the EAG Deputy Chairman or the EAG Executive Secretary and persons performing their duties as well.

    38. The public document is the EAG official document, which is intended for public circulation by its publishing in the mass media and on the Internet. The decision to grant the public status to the document (or part of the document) can be adopted by the EAG Plenary meeting, the EAG Chairman, the EAG Deputy Chairman or the EAG Executive Secretary and persons performing their duties as well.

    b. The deadlines to coordinate documents with the EAG member-states and other persons

    39. The deadlines to coordinate documents by the EAG member-states are:

  • 3 months from the date when they were sent by the EAG Secretariat - for the international documents. When it is not possible to coordinate on time the member-state shall inform the Secretariat on the impossibility of coordinating, for objective reasons;
  • 1,5 months from the date when they were sent by the EAG Secretariat - for the internal documents;
  • 1 month from the date when they were sent by the EAG Secretariat - for the public documents.

    If it is necessary to coordinate documents on more tight deadlines the EAG Executive Secretary can make a decision to impose another deadline. This deadlines are of recommendational character. In case of other deadlines for approval of certain documents the deadlines set by the EAG Plenary meeting are applied.

    40. Approval is provided by the letter from the EAG member-state to the EAG Secretariat with the official approval of the document and signed by the Head of delegation of the EAG member-state.

    41. If required the documents concerning the competence of the observers (other persons) can be sent to the observers (other persons) to receive their comments and proposals or for approval. The decision to send the document to the observers is made by the EAG Plenary meeting, the EAG Chairman, the EAG Deputy Chairman or the EAG Executive Secretary and persons performing their duties as well.
